Hakai - Terms of Service
Last updated: 21 October 2026
Hakai: Terms of Service · Privacy Policy · Delete your data
Applies to: the Hakai game for Android (package com.studio5pts.hakai) and any later version of it on other platforms, together with its online features (purchases, cloud save, sign-in, support). Called "the Game" below.
Who we are: 5PTS Games LLC, a California limited liability company, 2108 N St, Ste N, Sacramento, CA 95816, United States. Email: contact@5ptsgames.com. Called "we", "us" or "5PTS" below.
What you are buying - the short version
This summary is part of the Terms. If anything below seems to say something different, the detailed sections apply, and nothing in either takes away a right the law of your country gives you as a consumer.
- Hakai is free to play. You can play the whole game without paying. Some things can be bought with real money through Google Play (and later the App Store); everything else is earned by playing or bought with the game's gems.
- What you buy is a licence, not property. Gems, coins, cars, skins, wrench tickets, golden passes, the battle pass and ad removal ("Virtual Items") are a personal, non-transferable licence to use those things inside Hakai. They have no cash value, cannot be exchanged for money, and cannot be sold, traded or given to anyone else.
- Your purchase is delivered at once. You see the item in the game straight after paying. Google Play's purchase terms cover your agreement to that, and in the EU and UK they say the right to cancel ends once the item is delivered. Section 6 explains this, and what applies if the law of your country gives you more.
- Refunds. Purchases are final, except where the law or Google Play's refund policy says otherwise. Wherever you live, Google Play handles payments and has its own refund process (you can usually ask Google yourself within 48 hours of buying); after that, contact us. If something you paid for does not arrive or is lost through a fault on our side, we will put it back in your game - that is our remedy. Where the law of your country gives you a refund instead, you keep that right.
- Your game is backed up. Your progress is saved on your phone, and when you are online the Game also keeps a copy in our cloud save - for every player, without you signing in. Signing in with Google Play Games links that copy to your Google Play Games account, so a new phone can find it. A new phone that has not been played yet loads your saved game by itself if it is signed in to the same Play Games account; if two copies of your game have each been played further than the other, the Game asks you which one to keep, and what you bought with money comes with the one you keep.
- You can have your data deleted, but deleting it is not a refund. Cars, skin bundles and No Ads bought with money come back with Restore Purchases afterwards; gem packs and progress that are deleted do not come back (section 7.5).
- The Lucky Spin is a free reward wheel. Spins cannot be bought with money or gems. Its odds are shown on the wheel before every spin. Prizes are Virtual Items and have no cash value.
- Play fair. Cheating, editing the save, changing the phone's clock to gain rewards, or selling accounts or items can lead to us removing what was gained that way. You can always ask us to review a decision (within 60 days).
- We may change the game to fix it, balance it, or keep it legal and running, and we tell you about changes that matter. If we ever close Hakai's online services, we give at least 60 days' notice on our website and the Game's store listing, and stop selling first.
1. Agreeing to these Terms
1.1 Soon after you first open the Game - once any privacy choices have been answered, and always before your first purchase with real money - it shows you a notice with links to these Terms and to our Privacy Policy (https://5ptsgames.com/hakai/privacy.html), which explains what data the Game uses, and asks you to accept the Terms and confirm you have read the Privacy Policy. The Game records that you accepted, and which version of the Terms you accepted; you can see it in Settings > Support. By accepting, or by downloading, installing or playing the Game, you agree to these Terms. If you do not agree, please do not play the Game, and uninstall it.
1.2 Google Play's own terms also apply to your use of Google Play, including payments made through it. Where these Terms and the store's terms conflict on something only the store controls (for example, how a store refund is requested), the store's terms apply to that.
1.3 Age. You must be 18 or older, or the age of majority where you live if that is higher, to use the Game. If you are not, do not use it.
1.4 Changes to these Terms. We may update these Terms, for example when the Game gains a feature or the law changes. We will show the date at the top. For a change that matters to you (one that affects what you have bought, your rights, or how disputes are handled) we will publish the new version on this page, and say so on the Game's store listing, at least 30 days before it takes effect, unless the change is required sooner by law or is needed to fix a security issue; and the first time you open a version of the Game that includes the change, it shows you that the Terms have changed and asks you to accept them. If you do not agree to a change, you may stop using the Game; the change does not apply to a dispute that arose before it was made.
2. The Game and your licence to play it
2.1 We give you a personal, limited, non-exclusive, non-transferable, revocable licence to download the Game and play it for your own non-commercial entertainment on devices you own or control, in line with these Terms and the store's terms.
2.2 The Game, its code, cars, art, music, sounds, text and everything else in it belong to us or to the people who licensed them to us. Apart from the licence above you get no rights in them. You may not copy, modify, decompile, reverse engineer or redistribute the Game, or make derivative works from it, except to the extent the law where you live expressly allows it despite this term.
2.3 Streaming and videos. You may stream and post videos and screenshots of yourself playing the Game, including on channels that earn money from advertising, as long as you do not suggest we endorse you and you do not distribute the Game itself or its files. We may withdraw this permission for a particular use that harms the Game or other people.
3. Virtual Items and currencies
3.1 What they are. The Game has:
- Gems - the premium currency. Bought with real money in the shop, and also earned in the game (daily gifts, the battle pass, the Lucky Spin, optional reward videos and more).
- Coins - the everyday currency, earned by playing and also sold in the shop for gems.
- Items - cars, skins and skin bundles, car upgrades, levels, wrench tickets (instant repairs), golden passes (entry to Gem Rush), car rentals (a set number of runs in a car you do not own), the battle pass's premium track and tiers, and ad removal ("No Ads").
All of these are "Virtual Items".
3.2 A licence, not property. When you buy or earn a Virtual Item you get a limited, personal, non-transferable, non-sublicensable licence to use it in the Game, under these Terms. You do not own it, and it is not a deposit, a stored value, or money. Virtual Items:
- have no cash value and cannot be exchanged for real money, goods or services, or refunded for cash, except as section 6 and the law require;
- can be used only in Hakai, the game they were bought for (Google Play requires this too);
- cannot be sold, traded, gifted or transferred to another player or account, inside or outside the Game.
3.3 Prices. Prices for real money are shown in the shop in your currency as Google Play reports them, and Google Play's payment screen shows the final price before you pay. In the shop and on the battle pass, items sold for gems show their price in gems and, beside it, about what those gems cost in your currency at the prices of the shop's gem packs. That figure is a guide: you pay in gems, not money.
3.4 Changes to Virtual Items. We may change how Virtual Items work for valid reasons - to fix bugs, balance the game, keep it secure, or comply with the law - as section 9 describes. We will not:
- take gems, coins or items you hold out of your game, or lower the number you hold, except as sections 3.6, 5.4 and 8 allow (mistakes, refunded purchases, cheating);
- take away an item you bought with money, or with gems you bought, while the Game's online services run, except as sections 5.4, 8 and 9.2 allow.
Gem and coin prices of items not yet bought may change in future, as prices in any shop do; a change never applies to something you already bought.
3.5 Balances, spending order and expiry. Gems and coins do not expire while the Game's online services run and the Game is installed (section 10 covers shutdown). Gems you bought and gems you earned are the same gems and are spent together. A premium battle pass, a rental's runs and a rental's 48-hour discount last as the Game shows when you get them; a timed offer ends when its timer shows it ends.
3.6 Mistakes. If a Virtual Item is delivered by mistake (for example a pricing error, a duplicated grant, or a bug that pays a reward twice), we may correct the mistake by removing what was delivered in error. We will not take more than the mistaken amount, and we will not take back an item you paid real money for because its price was a mistake; any refund of that payment is as the law or Google Play's refund policy provides.
4. Specific features
4.1 The Lucky Spin. At the end of most runs the Game may offer one spin of a reward wheel. Each spin starts with an optional rewarded video, which you can decline.
- Spins are never sold. They cannot be bought with money, with gems, or on the battle pass.
- The odds are shown before every spin, on the wheel and in its Odds panel (the "i" button). Before each spin every wedge shows one prize, picked at random from its rarity; the percentage on a wedge is your chance of landing it. Prizes you already own are never offered.
- No Ads (section 4.3) can let you skip the video before a spin where the Game says so. It never gives you an extra spin, a better wedge or different odds, and in some countries the wheel keeps its video for everyone.
- Prizes are Virtual Items with no cash value; nothing on the wheel is money, a gift card, or anything with value outside the Game. The wheel is a game reward, not gambling.
4.2 The battle pass. Earning exp unlocks tiers on a free track and, if you buy premium with gems, a premium track. You can also skip tiers with gems. What each tier gives is shown on the pass before you buy anything; claiming is up to you, and premium bought late opens every premium tier you have already passed.
4.3 No Ads. Buying No Ads (alone, in the No Ads + Gems bundle, or with a premium car that includes it) removes the ad breaks between runs. Optional reward videos are skipped and you still get their reward. Before a Lucky Spin this happens only where the Game says so in your country, and only when a player watching the video would have been offered the spin at that moment. No Ads does not remove ads the Game does not control (for example, ads in the store) and does not change any odds.
4.4 Rentals and discounts. A rental ticket found on the road gives you a number of runs in a premium car you do not own. When the last run is used, the Game may offer that car at a discount for 48 hours, measured by the Game's clock. The discount is a separate store product at the price shown.
4.5 Daily gifts and rewards for items you own. If a reward gives you a skin or car you already own, the Game pays you its gem value instead, as it shows at the time.
4.6 Optional reward videos. Some rewards are given for watching a short advert. Ads are supplied by third-party networks; we choose the networks and the kinds of ads allowed, but we do not make the adverts and are not responsible for the advertisers' products, sites or claims. If an advert fails to play, the Game decides whether to give the reward as it shows on screen.
5. Buying with real money
5.1 The store processes payment. Real-money purchases are made through Google Play's billing system (on iOS, later, Apple's). For a purchase made through Google Play, Google is the seller you pay and the one that keeps the order record. We never see your card or bank details. The store's terms govern the payment itself, and the store may require you to have a store account in a country where the Game is offered.
5.2 Delivery. Purchases are delivered to your game on the device you buy on, normally straight away. A purchase paid "later" (for example with cash at a shop, where Google offers that) is delivered when the store tells us it has been paid. If a purchase does not arrive, open Settings > Restore Purchases, and if that does not help, contact us with your order number (from Google's receipt email) and the Player ID shown in Settings > Support.
5.3 Purchases on more than one device. Cars, skin bundles and No Ads bought with money are restored by Google Play, through Settings > Restore Purchases, on any device signed into the same Google Play account. Gems bought with money, and anything bought with gems, live in your save; they reach another device through the cloud save, which finds your saved game on a new device signed in to the same Google Play Games account (section 7).
5.4 Refunds, chargebacks and refunded purchases.
- Wherever you live, you can ask Google Play for a refund under Google's policies; Google usually lets you request one yourself within 48 hours of a purchase, and after that directs you to us.
- After that, contact us. Our remedy for a purchase that did not arrive, was lost through our fault, or does not work as described is to deliver or restore it in your game. Otherwise purchases are final, except where the law or Google Play's refund policy says otherwise: where the law of your country gives you a refund (for example under section 6.2), you get it. Nothing here limits a refund the law or the store gives you.
- If a purchase is refunded or charged back, the Virtual Items it delivered are no longer paid for, and we may remove them from your game, or remove the same number of gems. If you have already spent those gems, your gem balance may go below zero; gems you get afterwards make it up first. We will not lock you out of the Game, or out of anything else you paid for, because you disputed a charge.
5.5 Purchases by others on your device. You are responsible for purchases made on your device or with your store account. Use the store's purchase authentication (a password or biometric check for every purchase) if others use your phone. If someone made purchases without your permission, contact Google and us - we will help.
6. Your rights as a consumer - EU, UK and elsewhere
6.1 Your statutory rights come first. If you are a consumer, nothing in these Terms excludes, limits or changes any right you have under the mandatory consumer law of the country or state where you live (in the EU, for example, under Directive (EU) 2019/770 on digital content; in the UK, under the Consumer Rights Act 2015; in the United States, under consumer-protection laws that cannot be waived). Where a term would do that, it does not apply to you to that extent.
6.2 Faulty or missing items (all players). If a Virtual Item you bought is not delivered, does not work as described, or is lost through our fault, contact us. We will deliver or fix it, or restore it in your game, within a reasonable time and at no cost to you. If we cannot, or do not within a reasonable time, you may be entitled to a price reduction or a refund. In the EU and UK we are responsible for the digital content we supply conforming to the contract, as your law sets out.
6.3 Right of withdrawal - EU and UK consumers.
- A consumer in the EU or UK may usually cancel a purchase of digital content within 14 days, but loses that right once delivery has begun with their express consent and their acknowledgement that they lose it.
- Hakai delivers every purchase straight away. Google Play's checkout asks for that consent and that acknowledgement as part of the purchase, before you pay. The Game does not ask a separate question of its own, and Google Play's checkout and its receipt are the record of your answer.
- So once a purchase is delivered, you can no longer withdraw from it. An item that is faulty, missing or not as described is still covered by section 6.2.
- If the law of your country nonetheless gives you a right to cancel a purchase - for example if it treats in-game currency you have not yet spent differently from other digital content - you keep that right (section 6.1). To use it, email contact@5ptsgames.com within 14 days of buying, with "Withdrawal" and your order number, or use Google Play's own refund process where it applies.
6.4 Where you can bring a claim. See section 13. If you are a consumer in the EU or UK, you may always bring a claim in the courts of the country where you live, and the mandatory consumer protections of that country's law apply to you whatever law these Terms choose.
7. Saves, cloud save and sign-in
7.1 Your save is on your phone. The Game saves your progress on your device, and the save on your phone is the one in charge: you can always play offline. The save is built to survive a crash or a power loss mid-save, and Android's own backup may also copy it if you have that turned on.
7.2 Cloud save - every player. When you are online, the Game also keeps a copy of your save, including the record of your real-money purchases, on servers run for us by Unity Technologies ("cloud save"). It does this for every player, whether or not you sign in: once the Game has started its online services (after your privacy choices, where they are asked), it creates an account for you with Unity automatically - an anonymous one, holding no name, email address or password - and keeps the copy under it. The copy is updated when your save changes: straight away after a money purchase, and otherwise within minutes and when you leave the Game. A cloud save that has not been used for 24 months, under an account that has never made a purchase with real money, may be deleted (Privacy Policy section 6); one that has made such a purchase never is.
7.3 Signing in with Google Play Games. When your cloud save is linked to your Google Play Games account, another device signed in to the same Play Games account can find it. If Google Play Games on your device signs you in to games automatically, the Game signs in with it when it starts its online services and links your cloud save to your Play Games account by itself; Google Play Games' own settings decide whether it does that. Otherwise signing in is up to you: before your first purchase with real money the Game offers to sign you in so your purchases are kept safe; you can skip it, and it asks again at most twice more, a month apart. Without sign-in, your cloud save belongs to this installation of the Game only: if your device is lost, reset or replaced, or the Game is reinstalled, the copy usually cannot be found again, and unless Android's own backup restores your game we may be unable to restore your progress or gems. Cars, skin bundles and No Ads bought with money still come back through Restore Purchases (section 5.3).
7.4 A new device, and two copies of your game.
- A new device, or a reinstall, that has not been played yet. If the save on this device has nothing in it yet - or nothing but purchases Google Play restored or delivered to it, which come with your saved game - and your account has a saved game in the cloud, the Game loads your saved game by itself and tells you it did. It never writes a new, empty save over your cloud save. The save it replaced is kept as a file on your device, as the last point below describes.
- One copy simply played on from the other. If only one of the two has been played since they last matched, the Game carries on with that one without asking.
- Two copies that have each been played further than the other. This happens if you played the same game on two devices without them backing up in between, or if you played on this device before signing in and your Play Games account already has a game. The Game then asks you which game to keep, shows you what each one holds, and asks you to confirm your choice. It never picks one of two played games for you.
- What comes with the game you keep. Anything you bought with real money in the game you do not keep is added to the game you keep, each purchase once. Progress, coins, gems you earned, and things bought with gems stay with the game they were in.
- The game you do not keep is set aside, not deleted: as a separate copy in your cloud save and a file on your device, so that our support team can look at it if something went wrong. It cannot be loaded again from the Game, and we do not promise to bring it back.
7.5 Deleting your cloud data. You can delete your data at any time: in the Game at Settings > Cloud Save > Delete cloud data (you need to be online), or as https://5ptsgames.com/hakai/delete-data.html explains, by email.
- What is deleted. Everything the Game can reach: the copy of your save held online, the record of your purchases in it, any saved games set aside in the cloud under 7.4, and your cloud account. If our support team ever added items to your game, we delete that note too (the Game cannot delete it itself, so we do it when you ask, or when we find it left behind by a deleted account). Deleting cannot be undone. Cloud save then stays off on that device until you turn it back on.
- What is not deleted. The save on your phone, and any copies of saved games set aside beside it under 7.4, are not touched until you uninstall the Game or clear its data. The purchase and sign-in records Unity's in-app purchasing service keeps for us (Privacy Policy section 2.2) are not deleted by the Game, which cannot reach them; email us and we ask Unity to delete them. Google keeps its own record of every order you placed through Google Play, as the seller of record; that record is Google's, not ours. If the Game is installed on another device signed in to the same Play Games account, that device backs its own save up again the next time it is online, unless you delete there too or uninstall it. If you asked us by email, we keep your request and our reply for 12 months, to show the deletion was done, and then delete them too.
- An older cloud account. If the Game's data was cleared, or it was reinstalled, while you were not signed in to Google Play Games, the Game made a new cloud account, and the one before it is out of its reach: deleting in the Game deletes only the account it is using now. We delete an older one when you ask and can tell us something that leads to it (https://5ptsgames.com/hakai/delete-data.html).
- Deleting your data is not a reason for a refund, and you do not get one for it. What you bought with money is not lost by it: cars, skin bundles and No Ads bought with money come back through Settings > Restore Purchases on any device signed in to the same Google Play account, because Google keeps a record of them (the gems that come with the No Ads + Gems bundle come back with it). Gem packs, coins, your progress, and anything bought with gems live only in your save: once the cloud copy is deleted and the save on your phone is gone too, they cannot be brought back, by you or by us.
7.6 Our limits. We take reasonable care to keep your save and cloud save safe and working, but no storage is perfect. Cloud save depends on Unity's services, on Google Play Games if you sign in, and on your internet connection, and may sometimes be unavailable. Except as section 6 and the law require, we are not responsible for progress lost because of your device, your backup settings, signing into a different account, the game you chose to keep under 7.4, deleting your data, or a store or service outside our control. Paid items are treated as section 6.2 says.
8. Fair play
8.1 You agree not to:
- cheat, or use bots, modified versions of the Game, save editors, memory editors, purchase emulators or other unauthorised software to gain an advantage or Virtual Items;
- change your device's clock, or exploit a bug, to collect rewards, extend timers or discounts, or get items you did not earn; if you find a bug that gives free items, please report it to us;
- buy, sell, trade, or offer to buy or sell, Virtual Items, saves or accounts, for real money or anything else, inside or outside the Game;
- get Virtual Items through fraud, stolen payment methods, or refunds you are not entitled to;
- interfere with the Game's servers, cloud save or other players' data, or try to access data that is not yours;
- use the Game in a way that breaks the law or these Terms.
8.2 What we may do. If we reasonably believe you have broken section 8.1, we may - in proportion to what happened - remove the Virtual Items obtained by breaking it, reset the affected progress, or suspend or close your cloud save and sign-in account. We will tell you what we did and why unless the law or the security of the Game prevents it. You may ask us to review the decision by emailing contact@5ptsgames.com within 60 days; a person will look at it and answer. Items you bought with real money and did not obtain by breaking these Terms are not taken away for an unrelated breach without that review being available.
8.3 The Game is single-player and has no trading, chat or leaderboards, so cheating mostly affects only the cheater - but fraudulent purchases and refund abuse cost everyone, and we will act on them.
9. Changes, updates and availability
9.1 Updates. We may update the Game to fix bugs, improve it, keep it secure, comply with the law or with store policies, or keep it working on new devices. Some updates are required to keep playing online features. Updates are free.
9.2 Changes to content. We may change, rebalance, add or remove features, levels, cars, prizes and offers for valid reasons: to fix errors, balance the game, keep it secure, comply with law or store rules, respond to licensing limits, or because a feature is no longer economic to run. We do this without extra cost to you, and tell you clearly about a change that matters - in the update's notes and, where the Game can, in the Game itself. We will not remove an item you bought with real money, or with gems you bought, while the Game is available, unless the law, a licence ending for third-party content, or security requires it - and then we will give you a comparable item or the gems it cost.
9.3 EU consumers. If a change has more than a minor negative effect on your access to or use of something you paid for, we will tell you reasonably in advance and you may end your contract for that item free of charge within 30 days of being told or of the change, whichever is later, in line with Article 19 of Directive (EU) 2019/770.
9.4 Availability. We aim to keep the Game's online features available, but they may be interrupted for maintenance or by problems outside our control, and the Game may not work on every device or Android version.
10. Ending the Game's online services
10.1 We may stop offering the Game or its online services (purchases, cloud save, sign-in, ads). If we do, we will:
- give at least 60 days' notice on our website and on the Game's store listing, and in the Game in the last update we release before the services stop;
- stop selling gems and other Virtual Items for real money as soon as we give notice;
- keep the Game playable offline with the items you hold where that is technically and legally possible - Hakai is built to run on your device, so we expect it to - but we cannot promise that a store will keep offering it for download;
- give any refund or other remedy the law of your country requires for gems or items bought with real money and not yet used.
10.2 Your right to use the Game ends if you stop using it and uninstall it, or if we end it under section 8.
11. Disclaimers
11.1 We make the Game available "as is" and "as available". We work hard to make it fun and reliable, but we do not promise that it will be free of bugs, uninterrupted, compatible with every device, or that any particular feature or offer will stay the same, except as these Terms say.
11.2 To the fullest extent the law allows, we disclaim all warranties not stated in these Terms, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some places do not allow disclaiming implied warranties, so this may not apply to you, and it never affects your statutory rights as a consumer in the EU, UK or elsewhere (section 6).
12. Limitation of liability
12.1 Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or (for consumers in the EU and UK) for our responsibility for the digital content we supply conforming to the contract.
12.2 Subject to 12.1, and to the fullest extent the law allows:
(a) We are not liable for loss that was not foreseeable, or for loss of profits, business, revenue, goodwill or data (other than your game data, which section 7 deals with), or for indirect or consequential loss, however caused.
(b) Our total liability to you for all claims about the Game in any 12 months is limited to the greater of (i) the amount you paid for Virtual Items in the 12 months before the claim arose, and (ii) USD 50.
12.3 EU and UK consumers. If you are a consumer in the EU or UK, section 12.2 does not apply to you. Instead, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill; we are not responsible for loss that was not foreseeable. Where digital content we supply damages a device or other digital content of yours because we did not use reasonable care and skill, we will repair the damage or pay compensation.
13. Disputes and governing law
13.1 Talk to us first. Most problems are solved fastest by email to contact@5ptsgames.com with your Player ID and, for a purchase, the order number. We aim to answer within 5 working days.
13.2 Governing law. These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. If you are a consumer living outside California, this choice does not take away the protection of the mandatory laws of the place where you live, and you may bring proceedings there.
13.3 Courts. Subject to 13.2 and 13.4, the state and federal courts located in Sacramento County, California have jurisdiction, and you and we consent to them. You or we may instead bring a claim in a small-claims court that has jurisdiction.
13.4 Consumers outside the US may bring claims in the courts of the country where they live (in the EU, under Article 18 of Regulation (EU) No 1215/2012).
13.5 The EU's Online Dispute Resolution platform closed on 20 July 2025, so no link to it is given. We are not obliged to, and do not, take part in alternative dispute resolution before a consumer arbitration board, but we are happy to try to resolve any complaint directly.
14. General
14.1 Third-party services. The Game uses Google (Google Play for payments and refunds, Google Play Games for sign-in), Unity Technologies (cloud save and its accounts, the connection to Google Play's billing, and ads mediation) and the advertising, consent and analytics partners named in the Privacy Policy. Their own terms and privacy policies apply to them. We are responsible for our own obligations to you, including for the Virtual Items we sell.
14.2 Feedback. If you send us ideas or suggestions, we may use them without owing you anything.
14.3 Transfer. We may transfer our rights and obligations under these Terms to another organisation, for example if the Game is sold, and will tell you if we do; it will not reduce your rights. You may not transfer yours.
14.4 Severability. If a court finds part of these Terms unlawful or unenforceable, the rest stays in force.
14.5 No waiver. If we do not enforce a term straight away, we can still enforce it later.
14.6 Language. These Terms are written in English. If we give you a translation, the English version applies to the extent the law allows; where the law of your country requires the version in your language to prevail, it does.
14.7 Whole agreement. These Terms, the Privacy Policy and anything they refer to are the whole agreement between you and us about the Game.
