Terms of Service

These terms are an agreement between you and 5PTS Games LLC ("5PTS Games", "we", "us") covering your use of our games — Dinotopia, Titan Miners, and Hookshot Henry — and our website, 5ptsgames.com (together, the "Services"). By playing our games or using our site, you agree to these terms.
1. Playing our games
We grant you a personal, non-exclusive, non-transferable license to play our games for your own entertainment. You must also follow the rules of the platform you play on (such as the Apple App Store, Google Play, or a web platform's terms).
If you are under the age of majority where you live, you may use the Services only with a parent or guardian's permission.
2. Fair play
Please don't:
- cheat, exploit bugs for advantage, or use unauthorized tools, bots, or modifications;
- reverse engineer, copy, or redistribute our games or assets except where the law expressly permits it;
- use the Services for anything unlawful or harmful to other players.
We may suspend access to a game where it's reasonably necessary to protect other players or the Services.
3. In-app purchases and virtual items
Our games may offer optional in-app purchases, including virtual items or currency. Virtual items have no real-world value, cannot be exchanged for money, and are licensed to you, not sold. Payments are processed by the app store where you made the purchase, and refunds follow that store's policies — see our support page. If a purchase fails to arrive in-game after a successful payment, email us and we'll make it right.
4. Ownership
The games, their code, art, music, names, and logos belong to 5PTS Games LLC or its licensors. These terms don't give you any ownership rights in them.
5. Availability and changes
Our games are living projects — we update them, and some (like playtests) may change substantially or end. We may modify, suspend, or discontinue any part of the Services. Where a change materially affects paid content, we'll handle it in line with the relevant app store's policies.
6. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't promise the Services will always be uninterrupted or error-free (though we genuinely try).
7. Limitation of liability
To the fullest extent permitted by law, 5PTS Games LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or US $50. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
8. Privacy
How we handle data is described in our privacy policy.
9. Changes to these terms
If we make material changes to these terms, we'll update this page and its effective date before the change takes effect. Continuing to use the Services after a change means you accept the updated terms.
10. Governing law
These terms are governed by the laws of the United States and the state in which 5PTS Games LLC is organized, without regard to conflict-of-law rules.
